Introduction:

Welcome to Vevano. As a customer of Vevano your trust is our most important asset. We take the protection and proper use of your personal information seriously and are committed to protecting your personal information in our possession.

This privacy policy applies to all websites, call centers or other facilities that are operated by Vevano, LLC or any of its divisions or affiliates (collectively, "Vevano", "we", “our” and "us"). Each such website is referred to in this privacy policy as a "Site".

In this privacy policy, we describe Vevano practices for collecting, storing, using, and disclosing the personal (and other) information that we may obtain about you through any of the Sites. Please note that by using or accessing any of our Sites, you consent to the collection, storage, use and disclosure practices described in this privacy policy.

Information We Collect:

  • Online Purchases and Other Financial Transactions. When you make a purchase or engage in any other financial transaction on one of our Sites, you will be asked to provide information necessary to facilitate the transaction, such as your credit card or debit card number, expiration date, associated security code, telephone number, billing address, email address, and shipping address.
  • Registration. In connection with your registration or other interaction online with one of our programs, you may be asked to provide certain personal information, such as your name, email address, phone number, mailing address, and to generate a user name and password.
  • Sign-Up for Emails, Newsletters or Other Correspondence. You may choose to allow Vevano to use your information for E-Mails, Newsletters and other Correspondence. If you sign up on one of our Sites to receive such correspondence from us, you may be asked to provide us with your name, email address, and/or mailing address, along with other information related to your subscription or correspondence.
  • Contests, Sweepstakes, and Other Promotions. We may collect information about you when you participate in a promotion that we sponsor, such as a contest or sweepstakes (which we may sponsor alone or co-sponsor with one or more third parties). To participate in one of our promotions, you may be asked to provide your name and your email address, mailing address and/or other contact information. For some promotions, we may request other information about you as well. Note that your participation will be subject to the official rules of the promotion (as well as this privacy policy and the privacy policy of any co-sponsor).
  • Interactive Forums. You and other users may be allowed to post comments and other content on certain portions of our Sites, such as on a discussion board, blog or other interactive forum. We may collect any information that you or another user posts about you on one of our Sites, including personal information about you, and it may be available to all users who have access to the Site. Please keep this in mind when considering what information to post to our Sites.
  • Social Networking Activities. Our Sites may include the ability for you and other users to link to one or more social networking platforms (such as Facebook, Instagram or Twitter). We may receive information about you when you choose to post or otherwise share information about us on any of these social networking platforms. Note that any information that you or others post to a social networking platform will be accessible by any users of such platform, subject to its terms of service and privacy policy.
  • Usage Data. When you use or access any of our Sites, we may collect certain usage data generated by your activities on the Sites, including your purchasing history, pages viewed, number of bytes transferred, hyperlinks clicked, and other actions you take on our Sites. Each of our Sites may also track the URL that you visited before you come to the Site, the URL to which you next go, and your Internet Protocol (IP) address or mobile device identifier.
  • Location Data. Some of our Sites may collect information about your location, such as the approximate location of your IP address. Unless you provide us with your permission, this location data is collected anonymously in a form that does not personally identify you.

These tools are intended to make using our Sites easier by, among other things, saving your preferences for you. We may also use cookies to deliver content tailored to your interests.   • Third-Party Integrated Services. We may incorporate third-party ads and other third-party content on our Sites, and integrate other third-party offerings into the Sites, enabling certain such third parties to collect information about you or your online activities across other websites and over time through your use of our Sites. We may also incorporate Vevano ads and offerings onto third-party websites, enabling us to collect information about you or your online activities across other websites and over time through your use of websites with Vevano incorporated ads and/or offerings. Any information collected through such integrated technologies is collected directly by these third parties for use by such third parties and other authorized parties, subject to the privacy policies of those other parties.
  • Online Inquiries and Correspondence. When you submit an inquiry or otherwise correspond through one of our Sites, you may be asked to provide your name, email address, and/or other personal information to us.

We may keep indefinitely the information about you collected through our Sites.

 

How We Use Your Information:

We may use information about you collected through our Sites for a variety of commercial purposes.

Without limitation, we may use such information to:

  • Administer and improve our Sites and businesses;
  • Promote our products and services to you, as well as the products and services of our affiliates;
  • Promote (and enable the promotion of) third-party products and services to you that we think you may find of interest;
  • Deliver email communications, newsletters, and other correspondence to which you subscribe;
  • Communicate with you about our contests, sweepstakes and other promotions;
  • Conduct other marketing activities;

How We Share Your Information:

We disclose to third parties the personal (or other) information collected about you through any of our Sites either (i) when we have your permission to do so or (ii) in any of the following situations (without your permission):

  • We may share the information collected about you within the Vevano family of companies, which means we may disclose the information collected about you to our affiliates (subject to the terms of this privacy policy).
  • We may disclose the information collected about you to our third-party contractors and partners in connection with their performing services or other activities in support of the Sites and/or our businesses (which may include, but is not limited to, verifying the accuracy of the information you provide to us, providing customer service, delivering email communications, newsletters, and other correspondence to which you subscribe), or their completing or confirming on our behalf a transaction or series of transactions that you conduct with us.
  • As noted above, information about you collected by third-party ads, content or technologies integrated with any of our Sites may be disclosed to such third parties.
  • We may disclose the results of aggregated data about you and other users of our Sites without restriction. In these situations, we do not disclose to these entities any information that could be used to personally identify you.
  • We may disclose to one or more third parties the information collected about you as part of a merger, acquisition or other sale or transfer of any of the assets or business of Vevano and/or of any of our affiliates. Please note that the entity receiving such information in connection with one of these transactions may not comply with all of the terms of this privacy policy.
  • We may disclose information about you to the government or to other third parties to comply with the law, applicable regulations, governmental and quasi-governmental requests, court orders, subpoenas or other legal process, such as in connection with suspected illegal activity associated with any of the Sites or our business. We reserve the right to release information collected through any of the Sites to law enforcement or other government officials, as we, in our sole discretion, deem necessary or appropriate.
  • We may also disclose information about you to third parties if needed to enforce any of the terms of use for one of our Sites or other agreements, or any investigation of potential violations thereof; to detect, prevent, or otherwise address fraud, security or technical issues; to protect against harm to any of the Sites; or to protect our rights, property or safety or the rights, property or safety of our users or others (e.g., to a consumer reporting agency for fraud protection).
  • We may also, in certain instances, disclose your personal information when we have reason to believe that it is necessary to identify you, contact you, to advise you of a product recall, detect and protect you or us from fraud or theft, manage information security or bring legal action to protect your rights or the rights of Vevano or others.

Opting Out:

When you receive sales flyers, advertisements, direct mail, and other promotional communications from us, including email, you will have the opportunity to “opt out” by following the “unsubscribe” instructions in the email you receive or by contacting us directly.

Additionally, you may contact our customer service department directly to “opt out” of future communications with us.

We will use commercially reasonable efforts to update our files to reflect your request as promptly as possible.

Security:

We maintain physical, electronic and procedural safeguards to protect the confidentiality and security of personal information transmitted to us using the Sites and we undergo regular security audits to identify ways to improve our systems. To help guard your information, we use Secure Sockets Layer (SSL) and HTTPS methods so that any transmitted data is encrypted. SSL encrypts your personal information so only Vevano is able to decode your information. Please note that email is not encrypted and is not considered to be a secure means of transmitting credit card information.

To be sure your connection is secure locate the lock icon on your browser window. If you see an unbroken key or a closed lock (depending on your browser) the SSL is active and your information is secure. Most browsers offer additional security alerts as well. We also ask customers to carefully review their accounts and immediately report any unexpected activity to Vevano and your issuing bank or credit card company. Additionally, we are asking all our customers to take measures to help protect personal information in their online accounts, including the following:

  • Install the latest security updates and anti-virus software on your computer to help prevent malware and viruses;
  • Reset your email account password;
  • Use complex passwords (a minimum of 7 alpha/numeric cAsE sEnsitive characters);
  • Do not use the same password on more than one website;
  • Do not share your password with others;
  • Password protect your personal mobile device(s);
  • Sign out/log off website sessions so that your session is closed and cannot be accessed by another user on the same computer, especially when using a public computer or terminal; and

Transfer of Data from Outside the United States:

If you use any of our Sites from outside of the United States, information that we collect about you through the Site will be transferred to servers inside the United States and maintained indefinitely. By using the Site, you consent to the transfer of data about you into the United States, as well as the processing of such data in the United States.

Cookies and Other Similar Technologies:

Our Site uses "cookie" technology. We use cookies to identify your device, provide website user authentication, conduct fraud prevention and management services, distinguish you from other visitors, record your IP address and understand your use of our Site, and identify the name of the Web site you linked to or from Vevano. This information is used for fulfilling contracts with our business partners, and to help us serve you better by improving our website design, as well as our products, services, and promotions. A cookie is a small data file that is placed on the hard drive of your computer when you visit a website. A "session cookie" expires immediately when you end your session (i.e., close your browser). When you visit our Site, we may use both a session and a persistent cookie. This Vevano-placed cookie may contain information (such as a unique user ID) that is used to track your usage of our Site and in some cases, your email address.

The Vevano-placed cookie allows us to recognize you when you return to our Site and provides you with access to your account information. If you save your information with or order from us, we may also use cookies to monitor and maintain information about your use of our Sites. If you have not saved your information with or ordered from us, we may monitor and maintain information about your use of our Sites in a manner that does not identify you. This privacy policy only addresses Vevano practices for the personal (and other) information that we may obtain about you through any of the Sites. Please be aware that when you use or access any of the Sites, you may be directed to other websites that are beyond our control, and Vevano is not responsible for the privacy practices of third parties or the content of linked websites. We would expect most, if not all, of these third parties will collect information about you when you use their offerings. However, Vevano is not responsible for the privacy practices of third parties, regardless of whether they are linked or otherwise connected to our Sites. We encourage you to read the posted privacy policy and terms of use whenever interacting with any third-party website, app, or other offering.

California Privacy Rights:

California law entitles residents to ask us for a notice describing what categories of personal information we share with third parties or with corporate affiliates for those entities' direct marketing purposes. Vevano does not provide any personal information to third parties for their own direct marketing purposes. Governing Law:

By choosing to visit any of our Sites, you agree that any dispute over privacy or the terms contained in this privacy policy will be governed by the law of the State of Utah, without reference to the choice of law or conflicts of law principles thereof, and will be subject to the dispute resolution clause contained in the terms of use applicable to the particular Site. You also agree to abide by any limitation on damages contained in the terms of use applicable to the Site or any other agreement that we have with you.

Business Transitions:

As we continue to develop our business, we may undergo a business transition such as acquiring another company, merging with an existing company, or selling a portion of our assets. In such transitions, customer information is typically one of the business assets that is transferred or acquired by a third party. In the unlikely event that Vevano or substantially all of its assets are acquired or enter a court proceeding, you acknowledge that such transfers may occur and that your personal information can continue to be used as set forth in this Privacy Policy.
